- The calculation
- Days between publication (September 20, 2017) and closing (October 5, 2017), rounded to the day: 16 days.
- What goes in
- The source publishes no duration for this notice: the number comes from its two dates. A gap of less than half a day, or a closing before publication, gives no window.

Nature of Requirements:
1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement
The Canada Border Services Agency (CBSA) has a requirement for the purchase of an infrared FT-IR spectrometer system for use by document examiners and chemists in casework examinations in a laboratory environment, in the field of alcohol, tobacco, e-liquids, polymers and textiles. The system must integrate into CBSA’s existing infrastructure.
The requirement includes the following components:
- Thermo Fisher iS10 Mid Infrared FT-IR Spectrometer;
- Thermo Fisher Nicolet iN5 microscope with MCTA detector;
- Thermo Fisher Nicolet TGA-IR module with OMNIC series and vapor library; and
- a 12-month standard system warranty, a 10-year warranty on the interferometer, a 5-year warranty on the laser, and a 2-year warranty on the source.
3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier must demonstrate by way of a statement of capabilities that its instrument meets the following requirements:
a) The interferometer must be dynamically aligned and must provide at least 50,000:1 peak to peak signal to noise, measured at 4 cm-1 resolution by collecting 80 seconds background, 60 seconds sample, in the region 2200-2100 cm-1;
b) The accessory sample compartment must have automatic recognition and smart lock-in mechanical design compatible with SmartDuraSamplIR Smart accessory;
c) The ATR accessory must have a pressure tower with either a pressure gage or a clutch pressure-calibrated mechanism;
d) Users must be able to interchange the crystal disk in a matter of minutes without external help or the needs of tools;
e) The system must include a Performance Verification and the software must allow system Performance Verification for automatic monitoring of system status; and
f) The software must be compatible with OMNIC software and GRAMS-AI software (data in .spc and .spa types of files).
4. Applicability of the trade agreements to the procurement
This procurement is subject to the following trade agreements:
- Canada Free Trade Agreement (CFTA)
- North American Free Trade Agreement (NAFTA)
5. Justification for the Pre-Identified Supplier
Thermo Fisher Scientific is the OEM of the required instruments and is the only known supplier that can meet the above requirements and ensure interchangeability with CBSA’s existing infrastructure of infrared spectrometer systems and instruments, parts, components, consumables, research protocols and methodologies and software platforms.
6. Government Contracts Regulations Exception
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - only one person is capable of performing the contract.
7. Exclusions and/or Limited Tendering Reasons
- Canada Free Trade Agreement (CFTA) - Article 513 (b)(v)
- North American Free Trade Agreement (NAFTA) - Article 1016.2 (d)
8. Period of the proposed contract or delivery date

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
